Royal AM's application to charge PSL & NSL for contempt has been dismissed.

The Royal AM application to charge NSL and PSL for contempt in allowing the playoffs to continue has been dismissed.


Judge Windell handed down his judgment on Monday, 26 July 2021, in the Gauteng High Court.


In their application, Royal AM had submitted that the PSL CEO, Mato Madlala, should be imprisoned for allowing the playoffs to continue despite the interdict of judge Nyathi.


Judge Nyathi provided three reasons, which justified that pending the application of Royal AM for leave to appeal, the playoffs should be suspended.


"Prayer one that the application be heard and determined as one of urgency as contemplated by rule 612 of the rules. Two that the first respondent’s conduct is inconsistent with the constitution and/or PAJA. Three, granting an interim order that pending the final determination of the application for leave to appeal and/or appeal 3.1 the commencement of the 2020/2021 GladAfrica Championship relegation and promotion play-offs is suspended," Nyathi said.


The Gauteng High Court, Judge Windell, has stated her reasons why she dismissed the Royal application.


"The relief Royal AM seeks runs contrary to the previous findings of the court and is not supported by fact or law. The interdictory relief granted by Nyathi AJ IN paragraph 3 came to an end when Sutherland DJP refused leave to appeal on 18 June 2021. Paragraph 2 of the order of Nyathi AJ did not have the effect of reinstalling Royal AM to the top of Glad Africa Championship and has been suspended by NSL application for leave to appeal," Windell said.
